Health Wallet Terms of Use

1. About these Terms

1.1  HotDoc Online Pty Ltd ABN 84 159 662 558 (WeOur or Us) provides the “HotDoc” online platform and websites for booking and managing medical appointments, supporting interaction and engagement between Clinics and Patients, and providing related functionalities and services (Platform).

1.2  “Health Wallet” is an optional feature within the Platform that allows Patient Users to store, view and manage their prescription information within a single digital location (Health Wallet).  It is designed to support Patient Users to keep track of their prescriptions based on user-configured settings.  Currently, prescription information can be added to Health Wallet by a Patient User manually entering token numbers from their prescriptions or scanning the relevant digital code to enable the prescription to be imported.

1.3  By registering an Account for the Platform, You have already agreed to Our Terms of Service, which sets out the basis on which We permit You to access Our Platform.  Those Terms of Service also apply to Your access to and use of Health Wallet.

1.4  These Health Wallet Terms of Use set out some additional terms and conditions that specifically apply to Your access to and use of Health Wallet, and form part of Your agreement with Us. In the case of any inconsistency between the Terms of Service and these Health Wallet Terms of Use, the Health Wallet Terms of Use prevail.

1.5  We may amend these Health Wallet Terms from time to time by notice to You, such as by email or notification within the Platform.  Any such amended version will apply to Your use of Health Wallet from the date of Our notice to You.  If You do not agree with the amended version, You should cease using Health Wallet.

2. Trial period

2.1  Health Wallet is provided to You on a trial basis only, to support Our product evaluation and development (the Trial). No fees will apply to Your access to and use of Health Wallet.

2.2  You acknowledge that Health Wallet:
a)  is being provided as part of a limited Trial and is not a generally available feature of the Platform;
b)  is provided on an “as is” and “as available” basis for product development and evaluation purposes only; and
c)  may be subject to alteration, change and discontinuation during or after the Trial.

2.3  We do not warrant that Health Wallet will operate without error, interruption, or delay during the Trial.

3. Display and access only

3.1  Health Wallet enables You to access and view prescription information sourced from third-party participating prescribing and dispensing systems (Participating Third Party Services), which is made available for Your convenience only.  It does not create, issue, validate, clinically assess or amend prescriptions, and the Participating Third Party Services operate independently of Us and remain the authoritative source of prescription information.

3.2  Health Wallet:
a)  is not a clinical system and does not provide medical decision-making, oversight or monitoring or assessment of Your prescriptions or clinical needs. Any queries regarding the accuracy, appropriateness, repetition, renewal, use or amendment of a prescription must be directed to the prescribing Practitioner or relevant Clinic; and
b)  does not support the requesting, issuing, or authorisation of prescription repeats, tokens or changes (and such requests must be made directly to the prescribing Practitioner or Clinic).

4. Accuracy and limitations

4.1  Health Wallet may display active and, where applicable, archived, prescription information in a format that is consistent with that supported by the relevant Participating Third Party Services.  Expired, cancelled, or fully dispensed prescriptions may not be available for repeat, renewal, or further display through Health Wallet and must be managed through Your prescribing Practitioner.

4.2  The prescription information displayed in Health Wallet may not be complete, current, or free from errors or delays. Such information may be affected by factors outside Our control, including system availability, timing of updates, or actions taken by Participating Third Party Services. You should confirm prescription details with the prescribing Practitioner, Clinic or dispensing pharmacy where accuracy is important.

4.3  You must retain appropriate copies of Your prescriptions and any related information (including hard-copy and digital versions).  Health Wallet should not be relied upon as Your sole record of prescription information, and does not replace the need for You to retain the original paper or electronic prescriptions.

5. Your feedback

5.1  During the Trial, We may ask You to provide Us with feedback regarding Your experience using Health Wallet, its functionalities, performance and usability.

5.2  Any feedback provided may be used by Us to evaluate, improve or develop Health Wallet and the Platform and its broader features and functionalities.  You acknowledge that any feedback You provide does not confer on You any intellectual property rights in Health Wallet or Our Platform, or any improvements derived from such feedback.

6. Privacy and collection notice

General
6.1  Our collection, use, disclosure and handling of Your personal information and health information in connection with Health Wallet is governed by Our Privacy Policy and the privacy-related provisions of the Terms of Service.  These Health Wallet Terms describe additional matters specific to Health Wallet and must be read together with those documents.

6.2  By activating and using Health Wallet, You consent to Our collection and handling of Your personal and health information in accordance with these Health Wallet Terms (including the collection notice contained in this clause 6), Our Privacy Policy and the Terms of Service.

6.3  If You use Health Wallet to store, upload, access or share information that relates to another person (including a dependant, family member, or other third party), You represent and warrant that You are an Authorised Person and have:
a)  obtained all necessary consents and authorisations (as required by law) from that person to Our collection, use, disclosure and handling of their personal and health information in accordance with these Health Wallet Terms, the Terms of Service, and Our Privacy Policy; and
b)  provided any necessary notifications to them in connection with the above and on Our behalf.

6.4  Our collection:
a)  Health Wallet may involve Our collection and handling of Your personal and health information.  The type of information will ultimately depend on how You use Health Wallet, but may include Your name and contact details, prescription information, identifiers (including government-related identifiers such as Your ‘individual healthcare identifier’ or Medicare number), demographic information and metadata associated with prescribing or dispensing events (Your Prescription Data), and any communications We have with You or feedback You provide about Health Wallet;
b)  while Your Prescription Data and any other personal or health information will only be collected at Your direction, information may be sourced indirectly from, or transmitted via, Participating Third Party Services; and
c)  We may also generate analytical data from or relating to Your Prescription Data and use of Health Wallet. While this will typically be on an anonymised and de-identified basis, from time to time this might comprise Your personal and health information.

6.5  Purpose and use:
a)  The primary purposes for which We collect Your Prescription Data and other personal and health information are to:
    (a)  enable and support Your access to and use of the Health Wallet feature, including its display and storage functionalities (and any additional functionalities We make available during or after the Trial, such as notifications to alert You when a prescription is expiring.  If You do not want to receive such notifications, You may elect to opt out);
    (b)  maintain, test, improve and develop Health Wallet and Our Platform;
    (c)  resolve any customer service or Platform issues You experience; and
    (d)  comply with legal, regulatory and conformance requirements.
b)  We may also use Your Prescription Data and Your other personal and health information (including any generated analytical data) for secondary purposes such as:

    (a)  broader product development;
    (b) 
to communicate with You about Health Wallet and the Platform; and
    (c)  to promote related products or services that may be of interest to You.  
This may include service-related updates, feature announcements, user research invitations and promotional communications or other direct marketing, in accordance with Our Privacy Policy and applicable law.  For information about how We handle marketing communications, including Your right to opt out, please see clause 9 of the Terms of Service.

6.6  Disclosures, storage and retention:

Your Prescription Data and any other personal and health information:
a)  may, from time to time, be disclosed for the above purposes to the third parties described in Our Privacy Policy;

b)  will be stored and handled in accordance with the storage and security arrangements described in Our Privacy Policy. Where information is stored or processed by third-party service providers, this will generally occur in Australia however may involve some offshore disclosures as described in Our Privacy Policy; and
c)  will be stored and retained by Us in accordance with applicable privacy and health records legislative requirements, unless and until You:
    (a)  delete an individual prescription from Health Wallet; or
    (b)  request that We delete Your Prescription Data by contacting us using the contact details contained in Our Privacy Policy; or
    (c)  delete Your Account for the Platform (in these circumstances, We may retain some of Your Prescription Data unless You request it be deleted).

6.7  Other information:
a)  You can choose not to provide Your personal information to us at any time, however this may mean that We are unable to provide You with the Health Wallet feature.
b)  Our Privacy Policy includes additional information about how You can contact us if you have any questions or would like to request access to or correction of Your personal information.

7. Defined terms

7.1  The following capitalised terms used in these Terms of Service have a particular meaning:
a)  Health Wallet has the meaning given to that term in clause 1.2;
b)  Health Wallet Terms means these Health Wallet Terms of Use;
c)  Participating Third Party Services has the meaning given to that term in clause 3.1;
d)  Privacy Policy means Our Privacy Policy, as published at https://www.hotdoc.com.au/practices/privacy-policy (and as amended from time to time);
e)  Terms of Service means Our Terms of Service for the Platform, as published at https://practices.hotdoc.com.au/terms-of-services-patients/ (and as amended from time to time);
f)  Trial has the meaning given in clause 2.1;
g)  a reference to We, Our or Us is a reference to HotDoc Online Pty Ltd; and
h)  a reference to You or Your is a reference to a Patient User (being the Patient and/or an Authorised Person, as applicable) of the Platform.

7.2  Where they are not otherwise defined above, any other capitalised words used in these Health Wallet Terms have the meaning given to them in Our Terms of Service.
